Privacy

Our privacy policy voluntarily complies with new Federal Government guidelines issued by the Privacy Commissioner and effective as of 21 December 2001. If you require further information regarding the guidelines, please go to the website of the Office of the Federal Privacy Commissioner.

Information collection and use
When you submit an enquiry with us, we ask for your name, email address and telephone number. Once you register and sign up for our services, you are not anonymous to us.

We also automatically receives and records information on our server logs from your browser, including your IP address, our cookie information and the page(s) you requested.

We use personal information to fulfil your requests for certain products and services. We will not use personal information for any purpose without your consent.

Information sharing and disclosure
We will not sell or rent your personally identifiable information to anyone. We may send personally identifiable information about you to other companies or people when:
• We have your consent to share the information;
• We need to share your information to provide the product or service you have requested;
• We need to send the information to companies or contractors who work on behalf of us to provide a product or service to you. (These companies or contractors do not have any right to use the personally identifiable information we provide to them beyond what is necessary to assist us.);
• We respond to subpoenas, court orders or legal process; or
• We find that your actions on our web sites violate the Terms of Service or any of our usage guidelines for specific products or services.

Changes to this Privacy Policy
We may amend this policy from time to time. If we make any substantial changes in the way we use your personal information, we will notify you by posting a prominent announcement on our pages.

Your consent
By using our products and services, you agree that you have been adequately informed of our privacy policy, have the capacity to understand it, and provide your voluntary consent for us to collect, use and disclose personal information in accordance with this policy. Clark Rubber is a franchised group of stores, and Clark Pools & Spas Service Vans is a group of franchised mobile service businesses. The Franchise Support Office is located in Melbourne, with individually owned and operated franchise businesses throughout Australia. Both the Franchisor, Clark Rubber Franchising Pty Ltd ACN 065 708 723, and our individual franchise owners may collect personal information from you. Our stores display at the counter our collection policy for information obtained in a store, and you may ask for a copy of that policy when you visit a store. Any reference to "we" in our privacy policy below includes both the Franchisor and our franchisees.

The types of personal information that we collect from you will depend on the circumstances. Competitions, for example, may require that you provide your name address and contact number.

What does it mean if you go on our Mailing List?

You can go onto our mailing list by various means such as completing the on-line form on our internet site, entering a competition or various other ways. This is the sort of information we collect:

Name
E-mail address
Street Address
Telephone number
Areas of interest or item purchased (e.g. foam, swimming pools, rubber range, home furnishings etc.

The information may be used to send a notification to you by mail, email or other means when information relevant to your areas of interest is sent out to our customers. The information may also be used to inform you of any forthcoming Clark event that might be of interest to you or to invite you to take part in other marketing activities such as surveys.

Email a Store

If you send an email to a Clark franchisee through our web site, the email will be sent to the franchisee via us, the franchisor company and may be monitored by us for business purposes such as customer service audit and verification.

Franchise Business Internet Registration

If you choose to register an interest in the potential acquisition of a Clark franchise, your information will be stored on our database and may be supplied to any external agents we may engage from time to time in relation to our franchise sales process. You may ask us to remove identifying information if you choose not to proceed with the enquiry at any point in time in the future. Registration means that you consent to us contacting you by telephone and by mail to provide you with further information.

Removing your details from our mailing list or other records

If you would like to be removed from our mailing list at any time, you can let us know by any of the following means:

Sharing of information between Franchisor, Franchisees and others

As we are a franchised business, information is shared between the Franchisor and our franchisees. The Franchisor may also disclose the information to a related company for statistical analysis, marketing or other reasonable purpose. It is our policy not to sell or pass on any personal information that you may have provided to us to any party external to our group unless we have your express consent to do so, unless it is to a service provider, such as a mail house, who is fulfilling a function for us. However, if the law requires us to disclose your information, then we have no choice but to do so and your information will be disclosed if we reasonably believe that is necessary to comply with the law.

Please note however that information will not be released until photo identification is produced. If you believe that any information that we hold about you is inaccurate or out of date, you should contact our Privacy Officer.
